This website is operated by Lucy Olive, trading as Lucy Olive Design. By using this website you are agreeing to follow the terms and conditions set out below. 

Lucy Olive, trading as Lucy Olive Design, reserves the right to change any information to the below terms and conditions or any other information on this website at any time, with or without notice. This can include but is not limited to these terms & conditions, services, pricing and products.

Privacy

To provide my services, I collect the information that you provide to me, such as your name, address and email address. I will never distribute, sell or use your details for any other reason.

The information contained in this website has been prepared solely for the purpose of providing information about Lucy Olive Design and the services I offer. Lucy Olive shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access this website. This includes viruses alleged to have been obtained from this website, your use of or reliance on this website or any of the information or materials available on this website, regardless of the type of claim or the nature of the cause of action. By your use of this website, you agree that you are using this website solely at your own risk.

Payment information

When you make a payment, we do not store any information other than what is listed above. We use third party financial services facilitated by payment provider Hnry. Your card details are used through an encrypted server; your order is being processed safely and securely. We do not see any of your card information before, during or after this process.

Copyright

All content within this website, included but not limited to, text, logo, graphics, images and product designs are all the property of Lucy Olive, trading as Lucy Olive Design. Downloading, reproducing, copying or republishing is strictly prohibited without prior written approval. For more information please visit the Copyright Council of New Zealand.  

All pictures used from this website and any associated social media accounts must be credited and receive prior written approval before they are used. We reserve the right to decline requests to use the images at any time.

All preparation materials, sketches, visuals, including the electronic files used to create projects remain the property of Lucy Olive. The final artwork/digital files will become the property of the client upon final payment of the project. The client may not use, modify or replicate any proposed ideas or designs before final payment has been made.

Lucy Olive reserves the right to use the artwork, at any stage of the design process, for marketing purposes. If you have any specific confidentiality requirements, please mention this as soon as possible.

Pricing & Payment

All prices stated on the website and in communications are in New Zealand dollars unless mentioned otherwise. Lucy Olive Design reserves the right to change the price of goods at any time without notice. Taxes are included in the total price of each item. Lucy Olive Design is not currently GST registered, therefore GST is not charged on goods and services at this time.

Prior to the commencement of your project, a nonrefundable 50% deposit of the quoted price may be required. The final balance is due towards completion of the project when all artwork has been approved. Only when the final payment has been received will any files be released. Any additional concepts, alterations or work not specified in the initial project proposal will be re-quoted. Account details are located on the invoice. Designs remain the property of Lucy Olive until all outstanding accounts are paid in full.

Naming & Trademarks

If a Trademark, Copyright and/or legal name search is required, the client must seek independent legal advice. The client takes full responsibility for ensuring that the company/product/name is legally free before design work is started by Lucy Olive. Should any legal issue arise with the naming after the project has been completed, no refunds are possible, neither is Lucy Olive responsible for any problems thus arising.

Project Cancellation or Suspension

In the event of cancellation of a project, ownership of all copyrights and original artwork will be retained by Lucy Olive. The 50% deposit is non-refundable and will act as a cancellation fee. If Lucy Olive is unable to complete the project due to unforeseen circumstances, the complete deposit will be refunded. If the work completed so far can be picked up by another designer, then a percentage will be refunded based on usable work completed.

Lucy Olive reserves the right to suspend any project if a client is unable to move forward after showing more than a reasonable number of unique logo ideas/concepts and/or shows reluctance in paying the final payment. Fair notice will be given with fair chance to remedy the situation without resorting to project suspension.
